• Will, 27 Aug 1839, , Cecil, Maryland, USA. 10 WILL OF STEPHEN MAHONEY
In the name of God, Amen, I, Stephen Mahoney of Cecil County in the State of Maryland, being sick and weak in body, but of sound and disposing mind, memory and understanding, considering the certainty of death, and the uncertainty of the time thereof, and being desirous to settle my wordly affairs, do, therefore, make and publish this my Last Will and Testament, in manner and form following, that is to say-

First and principally, I commit my Soul into the hands of Almighty God and my body to the earth, to be decently buried at the direction of my executor hereinafter named, and after my debts and funeral charges are paid, I give and bequeath as follows -

Whereas, I hold a bond on my son John Mahoney and Otho Nowland and Benono Nowland, conditioned for the payment of the sum of Eight Hundred Dollars, dated on the 21st day of June in the Year 1839, to be paid in three equal payments, that is, one, two and three years after my death; reference being "hereunto had will more fully appear.

Now it is my will and desire, and I do hereby give and bequeath to
my daughters, now living and to the children of my two daughters that
are dead, Six Hundred Dollars of the above named, to be divided as
follows:
1st, To my daughter Ann Armer (Armour) One hundred and Fifty Dollar
to be paid to her or her heirs by the said John Mahoney in three
years after my death, without interest.
2nd. I give and bequeath to my daughter Elizabeth Atkinson the sum of
One Hundred and Fifty Dollars, to be paid to her or her heirs by
the same John Mahoney in three years after my death, without
interest.
3rd I give and bequeath to the children of my daughter Mary Hastin
(Hastings), the sum of One Hundred and fifty Dollars, to be
equally divided between them, share and share alike, and to be
paid to them or their heirs, by the above John Mahoney in three
years after my death without interest-
4th I give and bequeath to the children of my daughter Margaret
Pluck, the sum of One Hundred and Fifty Dollars, to be eqeually
divided between them, share and share alike, and to be paid to
or their heirs by the said John Mahoney in three years after my
death, without interest.
Item I give and bequeath to my son John Mahoney the sum of Two Hundred
Dollars, being the balance on his abovesaid bond, after paying
the hereinbefore mentioned legacys.
And Whereas I also hold a bond on William R. Mahoney and John W.
Jackson, dated June 21st, 1839, conditioned for the payment of
Five Hundred Dollars, in three equal payments, that is, in one,
two and three years after my death, reference "hereunto being
had will more fully appear. Now it is my will and desire and I
do hereby give and bequeath the said bond to the following
persons, viz. -
1st. I give and bequeath to my son Stephen Mahony (Mahoney) the sum of
Two Hundred Dollars to be paid to him or his heirs by the
William R. Mahoney, in three years after my death without
interest - Stephen to bring in no claim on my estate.

2nd. I give and bequeath to the children of my son Elisha Mahoney
(who is dead) the sum of Two Hundred Dollars, to be equally
divided between them share and share alike, and to be paid to
them or their heirs by the aforesaid William R. Mahoney, in
three years after my death, without interest, and any of the said
children of my son Elisha that may not be of age (that is, girls,
sixteen, and boys, twenty-one) at the time the legacys aforesaid
are payable, their respective share to be put to interest and
paid annually to their mother until they come of age - the said
William R. Mahoney is to retain his own share of the Two Hundred
Dollars bequeathed to Elisha Mahoney's children, and the balance
of the said bond, to be paid by the said W.R. mahoney to my son
John Mahoney AS my Executor, for him to apply it as hereinafter
bequeathed, said balance to be paid in three years after my death
without interest.
me interest that may be due on the two bonds above mentioned, at
my death and up to the end of the three years, to be paid to the
person that I have herein made my residuary legatee, said interest to
be paid her or her heirs annually as required by the conditions of
said bond.
Item. I give and bequeath to my son Jeremiah Mahony the sum of One
Dollar.
Item I give and bequeath to my daughter-in-law Martha Mahoney, my bed
and bedding, with all and singular the residue of my estate.
This bequest is to be paid in three years after my death.
And Lastly I do hereby constitute and appoint my son John Mahoney to
be Sole Executor of this my Last Will and Testament, revoking and
annulling all former wills by me heretofore made, ratifying and
confirming this, and none other, to be my last Will and Testament.
In testimony whereof I have hereunto set my hand and fixed my
seal this twenty-seventh day of August, in the year of Our Lord
Eighteen Hundred and thirty-nine.

Signed, sealed, published and declared by Stephen Mahoney the above named testator as and for his Last Will and Testament, in the presence of us, who at his request, in his presence, and in the presence of each other, have subscribed our names thereto.
