- Whereas EDWARD BERRY of this County died seized in fee of a certain tract of land scituate & being on the South side the Rappa: River, wch: sd. land is now in the occupacon of Mr. XPHR. BLACKBURNE, & Whereas the sd. BERRY did by his last Will & Testamt. devise the sd. land to the Children of KATHARINE his then Wife & his own to be equally devided amongst them and suit being made to this Court by EDWARD GEORGE, who marryed MARGRET, one of the Daughters of the sd KATHARINE, that devision might be made of the sd land according to the intent of the sd BERRYs Will, the Court have ordered that the land be forthwith devided into three equall parts according to quantity & quality and that JOHN BERRY Son of sd EDWARD BERRY deced have the first choice after such devision shall be made, and the other two parts to come & vest in EDWARD GEORGE in right of the sd MARGRET his Wife & SUSANNA BERRY, Daughter of the sd KATHARINE, Also that the charge of this Devision be equally borne amongst them"
