3-10-1848 Deed - William Lowrey from Thomas Lowrey Heirs; Deed delivered to owner Sept 3rd 1850 (Deed Book 23 Page 188) This is indenture made and entered into this 10th day of March in the ye ar of our Lord 1848 by and between ANDERSON LOWREY and CATHARINE his wif e; EDMUND CARR and NANCY his wife; GARNETT LOWREY and MATILDA his wife; JO HN NIBLACK and LOUISA his wife; of the County of Clarke and State of Kentu cky and JACOB FRITTS and JANE his wife; and THOMAS LOWREY and NELLY his wi fe; of the County of Madison and State aforesaid party hereto of the fir st part and WILLIAM LOWREY of the County of Clarke and state aforesa id of the second part witnesseth that the aforesaid party hereto of the fi rst part for and inconsideration of the following sums of money to wit thirty dollars to the aforesaid ANDERSON LOWREY thirty dollars to the aforesaid EDMUND CARR and NANCY his wife, thirty dollars to aforesaid GARNETT LOWREY, thirty dollars to the said JOHN NIBLACK and LOUISA his wife, twenty dollars to the said JACOB FRITTS and JANE his wife and the like sum of twenty to the said THOMAS LOWREY which several sums of money has been paid to others ___ as herein before n amed by the said WILLIAM LOWREY, the receipt of which is acknowledged by t he party hereto of the first part, the party hereto of the first part ha ve granted bargained and sold and by these presents do hereby grant barga in sell and release and convey unto the said WILLIAM LOWREY party here to of the second part, all of their undivided interest in and to a certa in tract or parcel of land situated lying and being in the said Coun ty of Clarke and State aforesaid on the water of Red River, said tract sup posed to contain 54 and an half acres, it being the same tract or parc el of land conveyed to THOMAS LOWREY by GEORGE GRAHAM, ANDREW RAMSEY and C ATHARINE RAMSEY by CHILTON ALLEN their agent by a deed of conveyance dat ed on the 30th day of July 1828 and was of record in the Clerks Offi ce of the County Court, and it being the same land JASPER R TODD now h as in his possession as tenant of NANCY LOWREY, widow of said THOMAS LOWR EY now deceased and it being a part of the land that aforesaid THOMAS LOWR EY owned in his life time and ___ to the said NANCY LOWREY his widow for a nd during her natural life, then the same to belong to his children, sa id will is now of record in the Clerks Office aforesaid, they the aforesa id ANDERSON LOWREY, NANCY CARR, GARNETT LOWREY, LOUISA NIBLACK, JANE FRIT TS and THOMAS LOWREY being children of said testator THOMAS LOWREY and al so the party hereto of the first part for the consideration aforesaid do h ereby sell transfer and assign to him the aforesaid WILLIAM LOWREY all, in terest claim and demand which they or either of them have or may have as c hildren and desires or heirs at law of the said testator THOMAS LOWR EY in and to the personal estate , money and chooses in action ___ belo ng to them under said will the interest hereby sold and intended to be con veyed is the one undivided seventh part in and to said land and other prop erty herein before named which belong to the party of the first part, to h ave and to hold said undivided interest in and to said land and other prop erty to him the said WILLIAM LOWREY and his heirs and assigns forever, a nd the party hereto of the first part do & will ___for the under and the ir heirs executors and administrators forever warrant and defend the tit le hereby conveyed by them unto him the aforesaid WILLIAM LOWREY and his h eirs and assigns free from all claim or claims of them the party here to of the first part and free from all claim or claims whatsoever In testi mony whereof the said ANDERSON LOWREY and CATHARINE his wife, EDMUND CA RR and NANCY his wife, GARNETT LOWREY and MATILDA his wife, JOHN NIBLACK a nd LOUISA his wife, JACOB FRITTS and JANE his wife, and THOMAS LOWREY a nd NELLY his wife, have hereunto subscribed their names and affixed the ir seals the day & year first ___ written. Kentucky Clarke County pct We Pleasant Bush and William B Keas two of the Commonwealth Justices of t he peace for said County do certify that Catharine Lowrey the wife of t he written named Anderson Lowrey this day personally appeared before us w ho being examined privily and apart from her husband as the law directs vo luntarily with her own free will and consent relinquished their right of d ower to the premises conveyed by this deed and wishes the same committ ed to record in the proper office. Bullock deputy clerk for James W Bullock clerk of the County Co urt for the County aforesaid do certify that this deed from Garnett Lowr ey and others to William Lowrey was this day produced to me and acknowledg ed by the said Garnett Lowrey & Matilda his wife to be their act and de ed and the said Matilda being examined by me privily and apart from her sa id husband declared that she did freely and willingly signed and deliver s aid writing and wishes not to retract it and acknowledged said writing aga in ___ and explained to her to be her act and deed and ___ that the same m ay be recorded. Bullock, CK And on the 26th March 1849 the same was produced to me Jas W Bullock cle rk of said court and proven according to law by the oaths of Dudley Sto ne and Jno W Lougenecker witnesseth thereto subscribed to be the act and d eed of Anderson Lowrey, and on the 5th Oct 1849 the same is acknowledg ed by JACOB FRITTS to be his act and deed, and on the 5th Dec 1849 the sa me is acknowledged by EDMUND C KERR to be his act and deed, and on t he 25 of May 1849 NANCY KERR wife of EDM.' KERR, and on the 5 Oct 1849 JA NE FRITTS wife of JACOB FRITTS, and on 27th Oct 1849 NELLY LOWREY wi fe of THOMAS LOWREY being examined by me (agreeably to the dates above) pr ivily and apart from their said husbands declared that they did freely a nd willingly seal and deliver said writing and wishes not to retract, a nd acknowledged said writing again shown and explained that the same m ay be recorded, and on this day the same is acknowledged by THOMAS LOWR EY to be his act and deed, whereupon the said deed together with the foreg oing certificates hath been duly admitted to record in my office.
